1. Conditions of delivery and usage
1.1 The delivered image data may only be used in the context of the stipulated purpose. All other rights remain property of the Museum der Kulturen Basel (MKB) and, given the case, of other copyright holders.
1.2 Barring special agreement, the assigned right of usage applies to the purpose of usage as defined by the user (hereinafter referred to as contracting party).
1.3 Any form of usage, exploitation, copying, distribution or publication of the image data not stipulated in the contract is subject to a fee and requires prior explicit written approval by MKB.
1.4 The right of usage is obtained with the payment of the invoice. Until then, the right remains property of MKB. Formal usage permission is granted by the signing of this contract and payment of the specified fee. Beyond this, no further permission is issued. Failing payment within 60 days, this agreement automatically expires.
1.5 If the right of usage agreed upon is not exerted within a period of one year, the right is forfeit. The fees already paid shall not be refunded.
1.6 Storage, usage, or reproduction on data carriers of any kind is not permitted (except for technical processing of image material).
1.7 The contracting party undertakes to erase the image material from all data carriers, servers, etc. after expiry of the stipulated period of usage.
1.8 The right of usage cannot be transferred to a third party.
1.9 Any editing as well as distorting or discriminating usage of the material placed at the user’s disposal is forbidden.
1.10 MKB assumes no liability, especially as far as the infringement of personal rights or the rights of third parties are concerned. The identification of potential copyrights and compensation of copyright holders fall in the liability of the user. As far as personal images are concerned, it is up to the user to obtain the right of reproduction from the person depicted, prior to usage.
1.11 Loaned images and other data are to be returned to MKB within 6 months undamaged, in the case of a selection of samples within 4 weeks. Upon request, the data are to be returned immediately. If the material is not returned within the stipulated period, or returned in a damaged state, the user carries the costs of replacement or restoration. This provision also applies if the loss or damage is due to the action of a third party. If the original data cannot be replaced, the user is held liable to pay damages in the height of the forfeited usage potential.
1.12 Deliveries are only made against advance payment. After payment, the contracting party shall receive the order within 8 weeks.
1.13 Arrangements at variance with these terms of delivery remain reserved. They have to be submitted in written form.
2. Terms of reproduction
2.1 When rendering supplied or self-produced digital image data on the Internet, in online databases, or other electronic archives, screen resolution may not exceed 72dpi.
2.2 The reproduction of extracts requires explicit approval by MKB.
2.3 The labelling agreed upon and the copyright notice are to be included in every reproduction. MKB is to be cited as owner and holder in a clearly visible spot.
2.4 Upon request the user is obliged to submit a test print for approval by MKB.
2.5 MKB is to be supplied, unsolicited, with two specimen copies of each publication or sales item. MKB has the right to purchase further copies at the customary discount. If it is an online publication, the contracting party shall send MKB the URL unrequested.
2.6 MKB does not accept liability for the colour reliability of the supplied image data.
3. Governing law and place of jurisdiction
3.1 This contract is subject to Swiss law, notably the provisions of the Swiss Code of Obligations. The exclusive place of jurisdiction for disputes relating to or ensuing from this contract is the Civil Court of Basel-Stadt, CH 4001 Basel.
